Killer Pleads Guilty for Criminal Negligence
By Ziad Bitti :: Monday, February 16, 2009 :: 49117 Views :: Law & Order, Government & Society

Toronto, CANADA – “The tragic irony is that the Chaldean families leave a country of death, persecution and oppression hoping for a better life for them and their children.   Sadly, so many Chaldeans are being killed in their place of work or by being in the wrong place at the wrong time as in this situation,” says Alvin Sako.

Sako is referring to the death of Mark Shaba, 19, of Rexdale, runned over on Oct. 21, 2007, in a dispute in the parking lot of Arizona Bar and Grill on Carlingview Dr. The court preceding concluded with the electrician apprentice Gagan Deep Singh, 26, pleading guilty to criminal negligence causing the death.

Singh ran over the only Son of the Shaba family, a teenage kitchen cabinet painter, with a Ford Explorer after a dispute outside the bar.

Shaba died two hours after being run over from "crushing injuries," including a fractured pelvis, numerous broken ribs, laceration of his lower left lung, diaphragm, spleen and colon, court heard.

A Good Samaritan who saw Shaba's body and Singh's vehicle chased the fleeing Explorer and provided police with a description.

Singh "drove erratically and reached speeds of up to 160 km/h and disobeyed traffic lights in an effort to lose (his pursuer)," Crown attorney Elizabeth Moore said in an agreed statement of facts.

Singh and his three pals, who were drinking at the bar, met up with Shaba and his two friends outside after last call when Shaba was sucker-punched by Moore said.  "Shaba wanted to know who hit him. While a few punches were thrown, no one suffered any injuries.

"After a very brief scuffle, Singh and his friends went to his vehicle to leave, with Singh driving," Moore said.

"Another member of Shaba's group was engaged in a yelling match with Singh's rear driver side passenger. He safely entered the car and Singh proceeded to accelerate the vehicle forward, running over Shaba while the yelling continued."

Singh, who remains free on $100,000 bail, will be sentenced this April 14.
